Terms of Service

1. Who we are

TinyFleet PM ("we", "us", "our", "TinyFleet PM") is a software-as-a-service product operated by the individual owner of tinyfleetpm.com. Contact: sellecks1@yahoo.com (support address may change; check the website footer for the current one).

2. What this agreement covers

By creating an account, using the website tinyfleetpm.com, using the TinyFleet PM Android application, or purchasing a subscription, you ("you", "user", "customer") agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

If you are using TinyFleet PM on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you personally and the organization.

3. The service

TinyFleet PM is a lightweight fleet, asset, and maintenance-tracking application. Features may include: recording assets, scheduling maintenance tasks, tracking parts orders, uploading files and photos, sharing public "maintenance passport" pages, and generating QR stickers.

We may add, change, or remove features at any time. We will try to give reasonable notice for material changes that would degrade your existing functionality, but we are not required to preserve any specific feature.

4. Your account

You must provide accurate signup information (email, display name). You are responsible for keeping your password secure and for all activity on your account. Notify us at the support email above if you suspect unauthorized access.

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account.

5. Organizations, members, and roles

TinyFleet PM is organized around Organizations. Each Organization has an owner (the user who created it) and may have additional members with Admin, Member, or Viewer roles.

Organization owners can invite and remove members, change roles, and delete the Organization. Removing a member does not delete their user account or personal data outside that Organization.

Organization data (assets, tasks, files, parts, etc.) belongs to the Organization, not to individual members. When a member leaves or is removed, they lose access to Organization data.

6. Plans, pricing, and payment

Current plans and pricing are shown on tinyfleetpm.com/pricing. As of this draft, they are:

Payment is processed by Stripe. By purchasing a subscription, you also agree to Stripe's terms. We never see or store your full card number.

Subscriptions renew automatically at the interval you selected (monthly or yearly) until you cancel. Prices may change; we will give at least 30 days' notice before a price change affects your existing subscription, by email and/or in-product notice.

Sales tax, VAT, or other applicable taxes may be added to the price shown, depending on your billing location.

7. Refunds and cancellation

See the separate Refund Policy and Cancellation Policy documents, which are incorporated by reference into these Terms.

8. Acceptable use

You agree not to:

We may suspend or terminate accounts that violate this section, with or without notice. If we terminate for a material violation, no refund is owed.

9. Your content and data

You own the data you put into TinyFleet PM (assets, tasks, photos, files, notes, etc.). You grant us a limited license to store, process, transmit, and display that data solely to operate the service for you and your Organization.

We do NOT use your content to train AI models. We do NOT sell your data. We do NOT share it with advertisers.

You are responsible for ensuring you have the right to upload and share any content, including photos of people, third-party logos, and any customer data.

10. Public sharing (Maintenance Passport)

If you enable the public "Maintenance Passport" URL for an asset, that URL is publicly accessible to anyone who has it. You control which assets have this enabled. Rotating the share token invalidates the old URL. Disabling sharing takes the URL offline within a few minutes.

You are responsible for what you make public.

11. Service availability

We aim for high availability but do not guarantee any specific uptime percentage. Scheduled maintenance, third-party outages (Supabase, Vercel, Stripe, Google Cloud), or unforeseen events may cause interruptions. We will make reasonable efforts to notify you of extended outages via the website or email.

12. Data backup and export

We take regular backups of the service database. However, YOU should also export or back up your own data periodically if it is critical to your operations. Any Business or Home plan lets you export your Organization's data on demand from your dashboard.

If you delete your account or Organization, we permanently delete your data within 30 days, except where retention is required by law or for fraud/abuse investigation.

13. Third-party services

TinyFleet PM uses these third-party services to operate:

Your use of the service means your data flows through these providers. Each has its own privacy policy and terms; we choose these providers because they meet reasonable industry standards for security and reliability, but we are not responsible for outages or issues caused by them.

14. Disclaimers

TinyFleet PM is provided "as is" and "as available", without warranty of any kind, express or implied. We disclaim, to the fullest extent permitted by law, all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free from security vulnerabilities, or that the results obtained from using it will be accurate or reliable.

TinyFleet PM is not a safety-critical system. Do not rely on it as your sole record of maintenance for equipment where failure could cause injury, death, or major property damage. Keep independent records for anything safety-critical.

15. Limitation of liability

To the fullest extent permitted by law:

Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from: (a) your content or how you use the service; (b) your violation of these Terms; or (c) your violation of any third party's rights.

17. Changes to these Terms

We may update these Terms. Material changes will be announced by email and/or in-product notice at least 30 days before they take effect. Continued use of the service after the effective date means you accept the updated Terms.

18. Termination

You may terminate this agreement at any time by cancelling your subscription and deleting your account.

We may terminate this agreement at any time for material breach, with notice via the email address on your account. Upon termination, your right to use the service ends immediately. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, dispute resolution) will survive.

19. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles.

Any dispute arising out of or related to these Terms or the service will be brought exclusively in the state or federal courts located in Lewis County, Washington, and you consent to personal jurisdiction there.

Class-action waiver: you may bring claims only on your own behalf, not as a plaintiff or class member in any purported class or representative action.
